Colorado Becomes 2nd State To Decriminalize Psychedelics

Colorado Has Passed Proposition 122, The NATURAL MEDICINE HEALTH ACT of 2022

Prop. 122 will be Decriminalizing the Possession, Storing, Using, Processing, Transporting, Purchasing, Obtaining, or INGESTING NATURAL MEDICINE FOR PERSONAL USE AND EVEN GIVING AWAY NATURAL MEDICINE FOR PERSONAL USE WITHOUT REMUNERATION TO A PERSON OR PERSONS TWENTY-ONE YEARS OF AGE OR OLDER!

The current strategy for mental health in Colorado has fallen short of its objectives.COLORADO’S CURRENT APPROACH TO MENTAL HEALTH HAS FAILED TO FULFILL ITS

PROMISE. COLORADANS DESERVE MORE TOOLS TO ADDRESS MENTAL HEALTH ISSUES, INCLUDING

APPROACHES SUCH AS NATURAL MEDICINES THAT ARE GROUNDED IN TREATMENT, RECOVERY,

HEALTH, AND WELLNESS RATHER THAN CRIMINALIZATION, STIGMA, SUFFERING, AND PUNISHMENT. This proposal would decriminalize the personal cultivation, possession, use, and gifting of the following psychedelic substances for those over 21: DMT, ibogaine, mescaline, and psilocybin and psilocin (found in psychedelic mushrooms) (excluding peyote).

It would establish a framework for state-regulated locations where people might use psilocybin while being watched over by trained personnel.

The state may elect to establish regulated access to DMT, ibogaine, and mescaline beginning in 2026. (excluding peyote).

Local governments could regulate the operation of licensed establishments but could not forbid them from operating inside their borders.

The Department of Regulatory Agencies would get advice from a board of 15 individuals who would be chosen by the governor when formulating the rules for this controlled access framework.

Even though most researchers believe. these psychedelics are physically non-addictive, it would not change the status of these substances under federal law; all are prohibited and are categorized as "Schedule I" by the Drug Enforcement Administration, meaning they are thought to have "no currently accepted medical use" and a high potential for abuse.THE DEPARTMENT SHALL REGULATE THE MANUFACTURE, CULTIVATION, TESTING, STORAGE, TRANSFER, TRANSPORT, DELIVERY, AND SALE OF THE REGULATED NATURAL MEDICINE ACCESS PROGRAM IS ESTABLISHED.

HEALING CENTRES AND OTHER PERMITTED ENTITIES' PURCHASE OF NATURAL MEDICINE; AND THE PROVISION OF NATURAL MEDICINE SERVICES TO PARTICIPANTS.

THE DEPARTMENT SHALL ADOPT RULES TO ESTABLISH THE QUALIFICATIONS, EDUCATION, AND TRAINING REQUIREMENTS THAT FACILITATORS MUST MEET PRIOR TO PROVIDING NATURAL MEDICINE SERVICES, AND TO APPROVE ANY REQUIRED TRAINING PROGRAMS, BY NO LATER THAN JANUARY 1, 2024. THE DEPARTMENT SHALL ADOPT RULES REQUIRED TO IMPLEMENT THE REGULATED NATURAL MEDICINE ACCESS PROGRAM BY SEPTEMBER 30, 2024, AND SHALL START ACCEPTING LICENSURE APPLICATIONS BY THAT DATE WITH DECISIONS MADE ON ALL LICENSING APPLICATIONS WITHIN 60 DAYS OF RECEIVING THE APPLICATION.
